teernight.live (the “Site”) respects the intellectual property rights of others and expects users of the Site to do the same. In accordance with the U.S. Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512, this policy describes how to submit a notice of claimed infringement and how to respond to such a notice.
1. Our Position
If you believe in good faith that material on the Site infringes your copyright, you may submit a notice in the form set out below. We will investigate notices that comply with the DMCA’s requirements and, if appropriate, remove or disable access to the allegedly infringing material in accordance with the DMCA’s safe-harbor procedure.
2. How to Submit a DMCA Notice
To be effective under the DMCA, your notice must be a written communication that includes substantially the following:
- A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed (or a representative list of works if multiple works are alleged to be infringed at a single online site).
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material — for example, the URL of the page on the Site where the material appears.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and an email address at which you may be reached.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. False or Misleading Notices
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by any copyright owner or copyright owner’s authorised licensee, or by us. Please consult your legal advisor and 17 U.S.C. § 512 before filing a notice or counter-notice.
4. Counter-Notification
If you believe that material you have posted to the Site has been removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent. To be effective, your counter-notification must be a written communication that includes substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or, if your address is outside of the United States, for any judicial district in which we may be found, and that you will accept service of process from the person who provided notification of alleged infringement or an agent of such person.
Upon receipt of a counter-notification that complies with the DMCA, we may forward a copy to the original complaining party. The DMCA provides that the removed material may be replaced or access to it restored 10 to 14 business days after the counter-notification is received, unless the copyright owner files an action seeking a court order against the user.
5. Repeat-Infringer Policy
It is our policy to terminate, in appropriate circumstances, the access privileges of users who are determined to be repeat infringers.
6. Trademark Concerns
If your concern relates to a trademark rather than a copyright, please email support@teernight.live with the subject [Legal] and provide the trademark registration details, the URL where the trademark is allegedly being misused, and a description of the issue.
7. Confidentiality and Privacy
We may share notices and counter-notices with the parties involved (including the alleged infringer) and may publish them, with redactions of sensitive personal information, on a public-facing transparency report or with services such as the Lumen database. Do not include sensitive information you do not want shared in this manner.
